Booking policies

The rates listed on the website www.magicalexperiencesvallarta.com are valid on the date of the booking request and are subject to change without notice. Published rates are not guaranteed until payment is received. All reservations are subject to availability.
Confirmation numbers will not be issued until payment has been received in full. When you make a reservation, you must provide your data within the PayPal platform, or by written or verbal authorization to upload to your credit card. By authorizing the charge, you acknowledge our booking and payment policies, cancellation policies and disclaimer.
Changes to existing reservations are subject to availability and necessary tariff adjustments. Print your booking Boucher and present it when you register for the use of your reserved service.

Payment policies

We accept VISA, MasterCard and American Express cards for payments through the Paypal platform. Contact one of our Tourist Advisors if you prefer to pay by bank transfer or other means of payment.
Rates shown in Mexican pesos will be charged in Mexican pesos for all credit cards. Fees in US dollars will be charged in US dollars, also for Visa and MasterCard transactions.
For American Express transactions, US dollar rates will be converted to Mexican pesos at the exchange rate of the day. This conversion can cause a variation of up to 5% below or above the international currency fluctuation index and will be reflected in your statement.
Magical Experiences Vallarta and Associates are not responsible for this variation and by accepting these policies you acknowledge being informed on this exchange rate fluctuation and agrees that the charge through American Express will be made in Mexican pesos.

Waiver

Magical Experiences Vallarta and associates, are an intermediary between customer and suppliers of goods and services that appear on the website. As such, Magical Experiences Vallarta and associates, create the necessary business connections in accordance with their own standards of service and quality to provide services including but not limited to, accommodation, ground transportation.
Only the most accredited suppliers are selected for this purpose, however, Magical Experiences Vallarta and associates, cannot be held liable for your acts, omissions, errors or negligence. Travel services are subject to the conditions set by the suppliers, and their liability may, in turn, be limited by their rates and conditions of service.
Magical Experiences Vallarta and associates, solely in their role as intermediary for the customer and service provider and retains no legal authority or control over the personnel, assets, operation and/or property of the service provider. Through this means, the client authorizes Magical Experiences Vallarta and associates to act as mediator to book the services chosen for a travel package.
The commercial mediation service is carried out directly by Magical Experiences Vallarta and associates, from its headquarters located in the city of Merida, Mexico, using its own technology platform for all shopping channels: online, Customer Service Centers, telephone or any other channel. When booking a travel package with a destination outside Mexico, the customer accepts that the use of the services will be made outside Mexican territory, so Magical Experiences Vallarta and associates, establish a Value Added Tax of 10%, according to Mexican law (LIVA , Section IV of Article 29).
Magical Experiences Vallarta and associates declare: The photographic material published on its website is intended to provide an overview of the service in question and in no way it can be guaranteed that the service is delivered exactly as represented. Star ratings assigned to hotel accommodations and services are based on standards and quality Magical Experiences Vallarta and associates, which may not match the qualification criteria used elsewhere.
Travel service descriptions are updated regularly to maintain an accurate description of the product. However, Magical Experiences Vallarta and associates, cannot be held responsible for the variations that occur upon arrival. Magical Experiences Vallarta and associates, reserves the right to deny services to any customer at any time if and when it deems appropriate to do so.
Any claim or notice that the customer must submit about the services received must be filed in writing within 30 (thirty) days from the last day of travel.

Cancellation, Refund and No-Show Policies

Cancellation will be possible within 24 hours before the start of your reservation.
The refund will be 100% if made with the established deadline. In case you do not do so in that time there will be no refund unless it is for medical conditions (medical proof will be needed to apply it) or it will be valid for bad weather conditions.
In addition, for weather reasons, the tours may undergo changes in the itinerary without prior notice. Guides will always put customer safety first, so they can decide what activities to perform. If the reservation is made one day before the date on which the tour is carried out, it cannot be cancelled, only under special conditions as mentioned in the previous paragraph.
That’s why it’s important to stay in touch with our agents in order to provide them with a first-class service. The refund will be partial in case the reservation wants to cancel after 17:30 hours of the day after the tour.

In case of "No Show", that is, you do not show up for your tour, you can reschedule with an extra charge that can be from 0% up to 50% of the reservation depending on the tour you booked and our availability.
When refunds are applied, they will be valid within the next 15 working days after the request, provided they are in the above guidelines. For all our tours and services, the reservation time limit will be at 6:00 pm, please provide all the necessary data to make your reservation effective.
Likewise, we are not responsible for lost valuables, so you must always keep valuables with you.

Limitations on liabilities

Magical Experiences Vallarta and associates shall not assume any liability for claims, costs or expenses arising from injury to the customer or third parties, accidents, loss of life, loss or damage to personal property, lack of enjoyment, disorder, disappointment, distress, or frustration, whether mental or physical as a result of the following:
Acts or omissions caused by any party and/or employees other than Magical Experiences Vallarta and associates. Illness, theft, labor conflicts, mechanical failures, quarantine, government actions, time or any other circumstance beyond the direct control of Magical Experiences Vallarta and associates.
If the customer does not obtain the required travel documentation, including but not limited to a valid passport (for a period of at least 6 months after the start date of the trip), personal identification, visas, medical documents, etc., in which case no reimbursement shall be granted.
Magical Experiences Vallarta and associates are not responsible to the Customer or any third party due to the lack of documentation required by the customer. If the customer does not comply with travel instructions including, but not limited to, flight schedules, check-in dates and times and hotel check-out and coupon refund policies.

Changes or cancellations of travel services offered for any reason, Magical Experiences Vallarta and associates, reserves the right to cancel or change travel services at your discretion, but try to replace the cancelled service with comparable ones. If a reservation must be cancelled completely, the liability of Magical Experiences Vallarta and associates will be limited to a refund of monies paid a Magical Experiences Vallarta and associates. A full refund will not be granted by Magical Experiences Vallarta and associates, in situations where a service must be interrupted, postponed or cancelled for reasons beyond its control (force majeure, including inclement weather, hurricanes, earthquakes, strikes, war, acts of terrorism, etc.)


The circumstances under which Magical Experiences Vallarta and associates are not authorized to obtain a full refund from operators services according to specific contractual terms. Magical Experiences Vallarta and associates, will be entitled to a retention of up to 10 on the total amount paid by the customer for his reservation to cover accounting and administrative costs.


Despite our ongoing rate verification, in rare cases there is the possibility that rate changes may occur without notice due to unforeseen events or force majeure. As tariffs sometimes expire and cannot be updated by the service provider in a timely manner, Magical Experiences Vallarta and associates, regularly runs a tariff verification process that may show differences between the price you paid for your reservation and the price you must pay to receive the service.


When an updated fare is less than the original fare offered to you, Magical Experiences Vallarta and associates will charge the lower amount. When an updated fare is higher than the original, Magical Experiences Vallarta and associates, will inform you of the price variation. If you do not agree with the revised amount, Expedition Merida and associates will refund 100% of the funds paid and will not be responsible of any claim or inconvenience arising from such difference in rates and/or cancellation of the reservation.
